Surrogacy law in the United Kingdom remains a complex and controversial area, often criticised for being outdated and failing to reflect modern family structures. The current framework, governed by the Surrogacy Arrangements act 1985 and the Human Fertilisation and Embryology Acts 1990 and 2008 , provides limited protection for the surrogate, intended parents and the child. This dissertation undertakes a doctrinal analysis to evaluate how effectively these laws safeguard the interests of all parties involved. Particular attention is given to issues surrounding parental orders, consent, and the non-enforceability of surrogacy agreements. Consideration is also given to the Law Commission’s proposed reforms, including the introduction of a new pathway and pre-birth parenthood.
