The Rights of Nature has emerged within recent years as a popular alternative to traditional environmental law, offering a rights-based approach to Nature. This dissertation investigates the development and operation of the Rights of Nature as a framework and a challenge to anthropocentric foundations of law, and whether this may be effectively incorporated into English and Welsh Law. It argues that RoN is a substantive legal innovation but may only be substantive enough if adapted to the contexts of parliamentary sovereignty and the common law. Using a comparative analysis of systems internationally, this study evaluates how ecological personhood may be put into practice, and whether this may be adapted to English law. It then evaluates the current Natures’ Rights Bill with this analysis in mind, pointing to potential successes, critiques and places of jurisprudential discomfort.
